The Introduction and Application Clause

1.1 This Website Terms and Conditions (T&Cs), which include any policies on First Care Solutions Group of Companies (AIEM, SHI, SGI and ER Consulting) website (“we”, “us” and “our”), apply to the ordering, sale and delivery of goods and services, access to the information and use of this Website by Customers (“you”, or “your”).

1.2 By using this Website you are bound by and agree to these T&Cs, which we may change without notice from time to time. If you do not agree to any of the T&Cs you should not continue to use the Website.

When placing an online order a user profile will be created for which will serve as consent to and acceptance of our T&Cs and Privacy Policy.

1.4 These Terms and Conditions are important and should be carefully noted as they contain provisions which, within the limits of the Consumer Protection Act, may limit First Care Solutions risk or liability, create risk or liability for you as a consumer, may compel you to indemnify First Care Solutions and serves as an acknowledgement by you of any fact.

1.5 Should you not understand any of the contents of these T&Cs, you are advised to contact First Care Solutions to assist with further explanation of the T&Cs before accepting them.

1.6 When you use our website, notwithstanding your geographic location, you do so in accordance with these Terms and Conditions and provided that any delivery address, including for returns collections, is a delivery address within the borders of the Republic of South Africa.

Services Clause

Prohibited Uses and Actions

The following activities on or through the Website and Social Media Platforms are expressly prohibited:

3.1 any non-personal or commercial use of any robot, spider, other automatic device or technology, or manual process to monitor or copy portions of the Website or Social Media Platforms or the content contained thereon, without the prior written authority of First Care Solutions Group of companies.

3.2 the collection or use of any listings, descriptions, and/or price lists from the Website or Social Media Platforms for the benefit of a competing merchant that supplies products comparable to those offered on the Website; and

3.3 any use or action that imposes an unreasonable or disproportionately large load of traffic on the Website or Social Media Platforms, or otherwise interferes with the proper and timely functioning of the website or social media platforms;

3.4 any attempt to gain unauthorised access to the Website or its related systems or networks;

3.5 accessing the Website for purposes of monitoring its availability, performance or functionality, or for any other benchmarking or competitive purpose; and

3.6 the reverse engineering or decompiling of the Website to (without limitation)(i) build a competitive product or service; (ii) build a product using similar ideas, features, functions or graphics of the Service; (iii) copy any ideas, features, functions or graphics of the Website.

3.7 When you register on the Website, you will be required to provide certain access details, including a username and a password. You are responsible for maintaining the confidentiality and security of your Username and Password for access to the Website and you accept full liability for all activities that occur on or involves the Website under your Username.

Before making any decision or taking any action which might affect you or your business, you should take all reasonable steps to ensure and verify the accuracy of the contents, data and information obtained from this website, especially if certain information appears to be inaccurate, particularly product pricing and promotional content.

Information accuracy

We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of Goods on the Website. However, should there be any errors of whatsoever nature on the website (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid, or otherwise as set out in the Returns Policy.

Account Termination and Suspension

5.1 First Care Solutions may, in its sole discretion, change any of these Terms and Conditions at any time. It is your responsibility to regularly check these Terms and Conditions and make sure that you are satisfied with the changes. Should you not be satisfied, you must not place any further orders on, or in any other way use, the Website.

5.2 Any such change will only apply to your use of this Website after the change is displayed on the Website. If you use the Website after such amended Terms and Conditions have been displayed on the Website, you will be deemed to have accepted such changes.

Shipping & Delivery

6.1 Delivery fees vary depending on your selected delivery option and Items ordered. Orders are calculated per item and in accordance with the location of your delivery address. The delivery fee will be displayed during the ordering checkout process, but before checkout has been finalized.

6.2  We will notify you via email as to the progress of your order, and you will also be able to track your order on the courier Website.

6.3 Upon delivery or collection of your order a delivery/collection note will be issued for signature, reflecting the Items that are being delivered or collected, delivery fees, Value-Added Tax and the amount paid.

6.4 You should always check that the Items being collected or delivered are correct and are free from any defects. Should the packaging be damaged and you accept the order without fully inspecting the Items you should add a note on the delivery note stipulating that the packaging was damaged, or items were not inspected. Where there is an issue with the Items detected after acceptance of the order, you should notify our Support Zone without delay in order for us to be aware of any issues with the Items and in order for arrangements to be made for the items to be returned/refunded. We are not responsible for items not identified and communicated as stipulated above.

6.5 Although reasonable care shall be taken, we cannot accept responsibility for incorrect delivery details that have been provided to us, or if an unauthorised person at your chosen delivery address accepts delivery of your order, as we do not verify the identity of the person at the delivery address who signs the delivery note.

6.6 After 2 (two) failed attempts to deliver your order to you at your chosen delivery address via our couriers services, your order shall be returned to us and the purchase shall be reversed after the cost of the second delivery has been deducted.

6.7 For purposes of this clause “we, us, our” shall include any agent or independent contractors who may be responsible for delivery on behalf of us which shall also include courier service.

6.8 Once goods are handed over to the courier company First Care Solutions no longer assumes the risk of delivery.

Payments

We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.

Payment may be made for Goods via the following methods (depending on its availability and/or your eligibility to use such a method) –

debit card; where payment is made by debit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we are entitled to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your order for the Goods will be cancelled. You warrant that you are fully authorised to use the debit card supplied for purposes of paying the Goods. You also warrant that your debit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;

credit card: where payment is made by credit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we are entitled to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your order for the Goods will be cancelled. You warrant that you are fully authorised to use the credit card supplied for purposes of paying the Goods. You also warrant that your credit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;

Limitation of Liabilities

8.1 First Care Solutions cannot be held liable for any inaccurate information published on the website and/or any incorrect prices displayed on the website, save where such liability arises from the gross negligence or wilful misconduct of first Care Solutions, its employees, agents or authorised representatives. you are encouraged to contact us to report any possible malfunctions or errors by way of our support zone.

8.2 First Care Solutions shall not be liable for any direct, indirect, incidental, special or consequential loss or damages which might arise from your use of, or reliance upon, the website or the content contained in the website; or your inability to use the website, and/or unlawful activity on the website and/or any linked third party website.

8.3 you hereby indemnify First Care Solutions against any loss, claim or damage which may be suffered by yourself or any third party arising in any way from your use of this website and/or any linked third-party website.

8.4 The use of the Website is entirely at your own risk and you assume full responsibility for any risk or loss resulting from use of the Website or reliance on any information on the Website.

8.5 Whilst First Care Solutions takes reasonable measures to ensure that the content of the Website is accurate and complete, First Care Solutions makes no representations or warranties, whether express or implied, as to the quality, timeliness, operation, integrity, availability or functionality of the Website or as to the accuracy, completeness or reliability of any information on the Website. If any such representations or warranties are made by First Care Solution’s representatives, First Care Solutions shall not be bound thereby.

Refunds and Returns

9.1 Should you not be satisfied with any Item/s purchased on our website, you may return for refund, credit or exchange unused Items in a saleable condition within 10 (ten) calendar days, subject to producing proof of purchase (invoice or delivery note), via our courier services  Returns may be conditional upon you submitting photographic proof of the quality issue or defectiveness of the Product before we will approve the refund.

9.2 Should any Items purchased on our website be defective, these Items, if unaltered, may be returned for refund, replacement (where stock is available), or repair (where repair is possible) within 3 (three) months of the purchase date, subject to producing proof of your purchase (invoice or delivery note). Longer warranty periods or conditions offered by producers or distributors may be stipulated on these Items, in which case these warranty periods and conditions will apply in addition to our 6 (six) month warranty.

 9.3 Where manual EFT, Instant EFT, credit card, and debit card payments were made and returns are processed an EFT refund will be processed for items returned within 30 (thirty) days from receipt of items provided they are in acceptable condition or within 6 (six) months if Items were defective).
